Law Student Accsuing Chinmayanand Of Rape Takes A U-Turn In Court

The 23 year olf Law student who, last year, accused the former Member of Parliament (MP) from BJP, Chinmayanand of rape, turned hostile at the hearing in the special court in Lucknow on Tuesday.

Last year the 72 year old Chinmayanand was arrested in the rape case and in February he was granted bail.

When the 23 year old law student appeared before the judge of the special court which was set up on the directions of the Allahabad High Court, the student refused to accept any of the allegations which she had made against Chinmayanand earlier.

When the student turned hostile, the prosecution made an appeal to file a case under Section 340 of CrPc (false claim and false prosecution in a case) against the student.

The law student – enrolled in one of Chinmayanand’s educational institutions at Uttar Pradesh’s Shahjahanpur – had accused him of sexually exploiting her for over a year.

The complainant has now been asked to reply to the prosecution’s appeal. The next hearing in the case will be held soon said the court.

The law student had filed an FIR (First Information Report) against Chinmayanand back in 2019 on the 5th of September, nearly a week after her father had alleged that she had gone missing; the family had accused Chinmayanand of harassment.

The former Union Minister was then arrested on the 20th of September.

Soon after the 72 year old former BJP MP was arrested, the 23 year old law student was also taken into custody on charges of trying to extort an amount of Rs 5 crore from the ex-BJP.

An SIT (Special Investigation Team) was also set up by the Uttar Pradesh government for this case. On the 6th of November, the SIT had filed a charge sheet in the rape case and also the extortion case against the student along with three others.

In December 2019, the Allahabad High Court granted bail to the 23 year old law student in the extortion case.

Earlier in 2020, the 72 year old Chinmayanand was granted bail by the Allahabad High Court which suggested a “quid pro quo” between the accused politician and the young woman and that they used each other.

Justice Rahul Chaturvedi of the Allahabad High Court, in his February order, expressed the astonishment that a “girl whose virginity is at stake” did not tell her parents or any other judicial body about the sexual exploitation which the girl was subjected to at the hands of the former politician from the Bhartiya Janata Party.

Two days later, the ex-BJP leader walked out of the Shahjahanpur district jail to a grand welcome by his supporters.

In March this year, the Supreme Court of Indian refused to cancel the bail granted to him, stressing that there is “no need to interfere” with the Allahabad High Court order.
